Shopify complaint: FalseUnsubstantiated DMCA Takedown Notice – Gross Contract Breach

My complaint:

I suddenly received an email out of the blue from shopify saying that the theme on my store is unlicensed or in other words, they are saying I stole(took from them without paying) a store theme and used it on my store – All lies of course as what happened was that I actually hired a shopify development partner and paid him fully to build the store from scratch – This shopify partner built the store but did a very messy and extremely sub-standard job, but I being the person I am just tried to work with the partner because I did not want to fall out with them, but essentially, I had to go back in and almost rebuild the whole store myself after the partner had returned the incomplete store back to me because try as I may to explain what was wrong to the shopify partner, they did not seem to get it, so they suggested that they turn the store over to me and I will correct the errors before we complete the project – Note that this was the first time I was getting any access to the store – so most everything (relating to the structure of the store)- things like the Theme used and Apps needed like Supplier Apps, Sales App etc were all already installed by the certified shopify partner – By the way, I also did ask shopify to check that this person was indeed a certified shopify development partner and they(shopify) ed this to be the case.
So I took control back and all I did was just carry out Spelling and Grammar errors, as well as correct other basic errors by the partner like setting the store up in the wrong currency, setting the store up in not the name I provided the partner for the store but somehow strangely named it something different – which I have since found is a generic store that the partner had already built before and was just flogging dishonestly to unsuspecting and naive first timers like myself – So a despicable scam – So I clearly was not the one who chose and installed the theme but the ed shopify development partner – who told me that the theme and everything involved in building the store was all included in the cost of my package for the project which I then paid him for in full.
After this, when I finished correcting the spelling errors etc and wanted to contact the shopify partner so as to return the store back to him to finalise the store build, and do things like change the store name back to my chosen name which I had given him from the start and set up the supplier App links etc – I found that he had disappeared!
I could no longer find or contact him and it quickly became clear that I had been scammed!
I immediately reported this to shopify but they did absolutely nothing about it and after chasing shopify for over 1 month trying to get some response and directly asking them for some sort of compensation and restitution of the damage incurred from working with one of their ed partners but getting absolutely no response from shopify, I gave up not because I could afford to give up on such a huge loss and injustice – and being scammed, but because it was looking futile a with regard to getting any reply let alone a satisfactory reply and also because I had a mountain of work to do and a lot to catch up on.

This brings us to the present day, and you can imagine my shock and horror when I woke up and found my store taken down – with pending transactions and costs rising – while I am also now being chased by customers who had alreaDy made a purchase but now could no longer see the store and have started instigating measures to recoup their losses and those banks and third parties are also now chasing me – All this added to monies put into ads being lost etc so the financial losses just keep rising – All this based on an illegal and unlawful action by shopify which has led to depression and 1 attempted suicide as well.

CAN ANYBODY HELP ME PLEASE? IS THERE ANY WAY I CAN TAKE THESE SCAMMERS TO COURT?? I CAN PROVE MY CASE WITHOUT A SHADOW OF A DOUBT.

Suggested solution:

Re-instate my store with it's original (fully paid for) theme and compensate me for all my losses which I will be more than happy to show and apologise for all the pain and suffering they have caused me.
Finally, they need to make a commitment to hire better and more trustworthy, knowledgeable, honourable and professional Development Partners so that innocent unsuspecting members of the public do not continue being set up by them to be scammed by their dodgy Shopify Development Partners
