My complaint:

I filed a complaint with USDARD-CSC Civil Rights Program about the Breach of Contract-Fraud Embezzlement of misplacing or not posting numerous mortgage payments. Along with not posting my application for Renewal of Payment Subsidy. I’ve also written letters to every branch within the USDARD-CSC to investigate these issues since 1996. They have tried to accelerate to foreclose for default for non-payment of mortgage payments a total of four times. The first time it happened I contacted several of the Centralized Serving Center Representatives and provided them with checks that had been stamped paid by my bank. Including my bank statements showing that I have in fact sent in my payments they were all on time. Yet I kept getting letters that they were going to accelerate the foreclosure. Desperate I called asked what can I do to stop this?

The representatives said to hire a lawyer. Which I did I won!! The other 2 times I represented myself again I won!! This fourth time I was not so lucky. I lost !! I had a Legal Aid represent me. I wasn’t able to represent myself due to the demise in my health with an end of life stage. Which has been brought on by all of this undue duress and huge financial burden this has caused me. Again they claimed I was behind with my mortgage payments. I contacted the the Default Management Group to go over what payments they had received posted. Come to find out they didn’t post 5 mortgage payments. Including my application for Renewal of Payment Subsidy. The assistant to the Default Manager was not allowed to correct these mistakes in OVERSIGHTS with my mortgage payments. The Default Manager said that was not her job to do that all they do is collect past due payments.

I wasn’t past due and I had turned in my Renewal for Payment Subsidy on time. Yet they were able to foreclose my home now putting it up for auction 2223. Is there anyway I can stop this due to the viable evidence that was not presented in court due by misrepresentation with my legal aid. Which the plaintiff’s attorney had this viable evidence in his discovery documentation of the history of my loan but never acknowledged or presented it. Which would have shown I was telling the truth that should be compensated for everything they have put me through. I hope that no one ever has to go through what I have. Ultimately losing with my life trying to save my home. Hear me roar!!!!!

Suggested solution:

By dismissing the foreclosure sale. Start from where I left off making my monthly payments and I pay my insurance property taxes. Also at a lower percentage rate than 7.25%. They pay for all the lawyer\'s fees everything else that had incurred when they stop accepting payments from me. Fix all of the issues with my house to bring it up to code like it should have been in the first place. Especially with removing all of the ASBESTOS TILE FLOORING Popcorn Acoustic containing asbestos in every room. I think that\'s fair. Or what would you price a human life lost??
