My complaint:

On Christmas Eve December 24th, 2024, I experienced a traumatic customer incident at the above No Frills (Ajmal’s) and I wish to request your close review of the facts concerning this incident.

A criminal offence has been committed against myself and my family.

Please review the details which I can also send by e-mail as it was very inappropriately handled by your customer care department and the area manager Cliff.

Please provide an e-mail where I can send the details and the address where I can formally bring this important matter to the office of the Chief Executive Officer.

Thank you.

Suggested solution:

This is an extremely serious matter as a criminal offence has been committed against myself.

Please find my last e-mail sent to Ajmal Shahjan on 04/24/2025.

Ajmal,
Good Afternoon.
During our meeting today, Thursday, April 24th, 2025, at 10:00 a.m., I declined to sign the attached document as it includes a non-disclosure clause that I believe it infringes on my rights.
As we briefly discussed, I must reiterate that a criminal offence was committed against me on Christmas Eve, December 24th, 2024, at your store by a security guard acting under the direction and authority of No Frills.
I would like to reference the relevant legal provisions from the Criminal Code of Canada regarding Assault:
________________________________________
Section 265(1) — A person commits an assault when:
• (a) without the consent of another person, they apply force intentionally to that person, directly or indirectly;
• (b) they attempt or threaten, by an act or gesture, to apply force to another person, if they have, or cause that person to believe on reasonable grounds that they have, the present ability to do so;
• (c) while openly wearing or carrying a weapon or imitation thereof, they accost or impede another person or beg.
Section 265(3) — Punishment:
• (a) an indictable offence liable to imprisonment for a term not exceeding ten years; or
• (b) an offence punishable on summary conviction.

Additionally, as previously mentioned, I have obtained a medical statement from my doctor detailing the trauma and psychological impact this incident has caused me.
It is deeply concerning that No Frills, in its effort to resolve this matter, has offered a payment of $200.00 — while clearly stating in the document:
“It is understood and agreed that the said payment ($200.00) is not an admission whatever of liability on the part of the Releasee.”
This document appears to have been reviewed—if not prepared—by legal counsel. Given the gravity of the incident and the criminal elements involved, I find No Frills’ response to be entirely inadequate and dismissive.
I remain committed to an amicable settlement in accordance with the law and my rights.
Sincerely,

Kris Kooblall
