My complaint:

Our 2005 Chevrolet Silverado was stolen 2-13-21, it was recovered by LAPD 2-14-21
About 5 days later, we chose Win Chevrolet as our repair center, because the vehicle was originally purchased there (when the dealer was still Cormier Chevrolet).

It was fixed, they called and said they would have to let it run, because the catalytic converters are new (which is what was stolen). In doing that, they realized the vehicle was smoking excessively – something was not right. I provided a copy of the last smog certification to prove it was running fine before it was stolen – The dealer and the adjuster agreed that everything was good with the last reading, as such I was advised the repair would be covered by my insurance. I didn’t hear much other than Win was talking to Allstate back and forth, then around June 30th Win Chevrolet called and said the vehicle was ready for pick up, I stated I would be there around 3pm to pick it up – I was told “we don’t need you, we need your wife”. I told my wife that’s ODD usually they request BOTH owners to be present.

My wife picked it up July 1st and called me immediately (she works about 2 miles from the dealer and drove it for about 6 minutes) stating that the truck was ticking, and the service rep told her it’s because the new motor had to settle. She also sent me a picture of the driver side mirror with yellow paint from a pole, which wasn’t there after the theft when we saw it in the impound yard. We then drove the vehicle for a bit, I noticed my oil gauge was spiking so we came home, once the truck settled, and cooled down I checked the oil – THERE WAS NONE it was barely touching the tip of the dipstick. Upon further inspection I found out my motor and surrounding accessories (IE starter, plugs and wires) were gone, and replace with a junkyard motor. It clearly was not running right, bolts were missing, connector pieces on the manifold, leaking oil, wires laying on the drive shaft, holes drilled in the motor in 2 places, bolts and a socket were laying on a bracket in the engine compartment and in some places the wrong bolts were put in. My truck has always been maintained by a professional mechanic with dealer only parts – it had a new starter, water pump, plugs and wires, all dealer parts from Win Chevrolet, yet now I see in my vehicle a junkyard motor, my motor and all my parts are GONE. I was advised my motor was being repaired, not taken out. My insurance company stated it was Win Chevrolets responsibility to inspect the quality of the motor, and they ordered it, The parts and service director

states it isn’t their job to inspect anything, that Allstate provided them the engine (which Allan at Allstate states is false) and they simply put it in. Allstate suggested we contact the Bureau of Automotive Repairs, which we did, they stated that legally they must be given the chance to correct the issues with poor workmanship. By this time John had told myself and my wife 1 thing, the adjuster something different, and the BAR a completely different story- so my wife asked that the adjust (Allan) conference call John so we could all have 1 conversation and 1 understanding. The moment Alan introduced himself John became agitated stating he would not discuss this matter – when Alan continued to explain we just want to understand where the disconnect is, John stated “JUST SUE US” and hung up, leaving all parties in disbelief, with Allan stating “wow he was very combative”.

I have pictures as far as the condition of my truck that was given to us, I returned it to the dealer because it was completely unsafe, I was advised I have NO WARRANTY AT ALL – how is that even possible??? The dealer states they did their job, my insurance company states they paid out over $15,000 so they did their job – yet we are stuck in the middle with an unsafe vehicle that is no where near the “like kind and quality” as it was stolen.

I do understand that is a 2005, but it was maintained properly and in good running condition prior to the theft.
We are awaiting the report from BAR. I feel that Allstate has partial blame in this as they repeatedly said, “we did our part we paid for the repairs” and I believe Win Chevrolet has fault because they installed trash pieces and did so very poorly.
I am confused as to how this can happen and I need help to resolve this matter
